This is a training web portal operated on behalf of the Agriculture and Horticulture Development Board (AHDB) by VBMS Ltd.

Please read these web portal terms and conditions of use carefully before using this site as they are a legally binding agreement between you and AHDB.

WHAT IS IN THESE TERMS AND CONDITIONS?

These terms and conditions tell you the rules for using our UK Pig Industry Welfare Training web portal:  https://ahdbpork.vbms.co.uk (referred to as the ‘Site’) and receiving any training services through the Site including the issue of any digital certificate by AHDB (‘Services’). Throughout this document we refer to the terms and conditions as the ‘Terms’.

A reference to ‘you’ or ‘your’ is a reference to the user of this Site.

We provide this Site and Service to you free of charge but reserve the right to charge you for continued access to the Site and Service at any time. We will notify you in advance if there are any charges associated with continued access to the Site and Service.

1. WHO WE ARE AND HOW TO CONTACT US

1.1   We are the Agriculture and Horticulture Development Board (AHDB), we are a non-departmental public body and our address is Stoneleigh Park, Kenilworth, Warwickshire CV8 2TL.  We are the providers of the Site.

2. BY USING THIS SITE OR SERVICE YOU ACCEPT THESE TERMS

2.2   These Terms set out all of the rules and obligations that apply to your use of the Site and receipt of any Services.

2.2   By registering on the Site or using the Site, you confirm that: (i) you accept these Terms and that you agree to comply with them; and (2) you are at least 18 years of age or over.  If you do not agree to these Terms or you are under the age of 18, you must not use our Site or Services.  These Terms are a legally binding agreement between you and AHDB.

2.3   These Terms may also make reference to other terms that apply when using the Site and Services, such as our Privacy Notice and Cookie Policy.

3. PRIVACY AND YOUR PERSONAL DATA

3.1   When you register for an account, make a purchase, or otherwise use our Services (including viewing our content) we will collect, use, transfer, disclose, and otherwise process your personal information as described in our Privacy Notice.

4. WE MAY MAKE CHANGES TO OUR TERMS

4.1   We may amend these Terms from time to time by updating them on the Site. We will also notify you through the Site or by email if we update our terms. Please check these Terms to ensure that you understand the terms that apply each time you wish to use our Site or Services. By continuing to use the Site or Services after the updated version of the Terms have been posted, you agree that you accept any changes to these Terms. If you do not accept these changes, please stop using the Site and Services.

5. WE MAY MAKE CHANGES TO OUR SITE

5.1   We may from time to time change the content of this Site, the nature of the Services or suspend or discontinue any aspect of this Site or Service, which may include your access to it.  You agree to any such changes and agree that these Terms will apply to all such changes made to the Site and your use of it and the Services.

6.REGISTERING AN ACCOUNT

6.1   To access the Site and receive the Services you will be required to create a user account (including creating a login name and password). If you do not complete the registration process, you will not be able to access the Site or Service.

6.2   You warrant to us that the information you provide during the registration process or otherwise is complete and accurate to the best of your knowledge. You will promptly inform us of any changes to your information.

6.3   You shall not share your login details with anyone else. You are responsible for the use or misuse of your login details and for maintaining the confidentiality of such log in details. You must promptly notify us of any actual or suspected confidentiality breach or unauthorized use of your login details or account.

7. YOUR OBLIGATIONS AND ACCEPTABLE USE

7.1   You accept that you are solely responsible for ensuring that your computer meets all relevant technical specification necessary to use this Site and receive the Services and that your computer is compatible with this Site.

7.2   You must not:

(a) misuse our system or this Site or Services. In particular, you must not hack into, circumvent security, decrypt, decompile, disassemble or otherwise disrupt the operation, source code or architecture of our system and this Site, or attempt to carry out any of the foregoing. This includes introducing viruses, trojans, worms, logic bombs or other material which is or could be malicious or technologically harmful. You must not misuse any forms on the Site and any forms you submit must be a genuine enquiry;

(b) use or attempt to use any automated programme (including, without limitation, any spider or other web crawler) to access our system, this Site or the Services. You must not use any scraping technology on the Site. Any such use or attempted use of an automated programme shall be a misuse of our system and this Site. Obtaining access to any part of our system, this Site or the Services by means of any such automated programmes is strictly unauthorised;

(c) upload or use inappropriate or offensive language or content or solicit any commercial services in any communication, form, or email you send or submit, from or to the Site;

(d) collect or harvest any information or data from the Site or Services or attempt to decipher any transmissions to or from the Site; or

(e) infringe our intellectual property rights or those of any third party in relation to your use of the Site or Service.

7.3   Whenever you make use of any feature that allows you to upload any content to our Site, or to make contact with any other users via our Site (if applicable), you must comply with any content standards set out in these Terms or provided to You by Us from time to time.

8.3   You must not, modify, remove, alter, scrape, distribute, republish, create derivative works, store (in whole or in part), frame, pass-off, make available to third parties or link to any other material or information on or downloaded from this Site  or provided as part of the Services without prior written consent from the copyright holder.

8.4   You may not commercially exploit the content.  Nor may you transmit it or store it in any other website or other form of electronic retrieval system.

9. WARRANTY

9.1   Whilst we endeavour to ensure that any material available for downloading from this Site or provided as part of the Services is not contaminated in any way, we do not warrant that such material will be free from infection, viruses and/or similar code.

9.2   Due to the nature of software and the internet, we do not warrant that your access to, or the running of, this Site will be uninterrupted, or error free.  We may suspend, withdraw, discontinue or change all or any part of our Site without notice.  We shall not be liable if you cannot access our Site or the Services due to circumstances beyond our control.

9.3   The content provided on this Site or as part of the Services is for general information only and does not constitute specific advice.  Although we make reasonable efforts to update and keep correct, the information on our Site, we make no representations, warranties, or guarantees or any kind, whether express or implied, that the content on our Site or provided as part of the Services is accurate, complete or up to date. We give no warranties or representations as to the accuracy or completeness of any of the information appearing in relation to any linked websites. The links are for your convenience only.  We do not endorse or recommend any views expressed within them, nor any products or services advertised on those websites. If you decide to access any third party website linked from this Site, or use any information available, you do so at your own risk. Any dealings you have with any third party are solely between you and that third party.

13. THIRD PARTIES

13.1   A person who is not a party to this agreement between you and AHDB shall not have any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any of these Terms.

14. OUR RESPONSIBILITY FOR LOSS OR DAMAGE SUFFERED BY YOU – DISCLAIMER

14.1   Whether you are an individual consumer or a business user we do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.

14.2   Subject to clause 13.1, while we make all reasonable efforts to keep the Site up and running smoothly, we will not be liable for any failures due to software or internet errors or unavailability, technical issues or any other circumstances beyond our control.

14.3   We will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack or other technologically harmful material that may infect your computer equipment, computer programmes, data or other proprietary material due to your use of our Site or to your downloading of any content on it, or any website linked to it.

14.4   If you are a business user, subject to clause 13.1:

14.4.1    we exclude all implied conditions, warranties, representations or other terms that may apply to our Site, the Services or any content provided;

14.4.2 we will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty or otherwise, even if foreseeable, arising under or in connection with:

15. WHICH COUNTRY’S LAWS APPLY TO ANY DISPUTE?

15.1   These Terms, their subject matter and their formation (and any non-contractual disputes or claims) are governed by English law.  To the fullest extent permitted by law, we both agree to the exclusive jurisdiction of the courts of England and Wales.

16. NO WAIVER OF OUR RIGHTS

16.1    If we do not enforce any provision of the Terms, that will not constitute or be construed as a waiver of such a provision or our right to enforce it.
